1 Overview

Vampires vs. Werewolves ("the Service") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA") and applicable international copyright laws, we will respond expeditiously to clear notices of alleged copyright infringement submitted to our designated Copyright Agent.

This policy describes the procedure for submitting a copyright infringement notification ("takedown notice") and for submitting a counter-notification if your content was removed as a result of a mistaken or misidentified claim.

Note: The DMCA process is designed for copyright infringement claims only. For other legal matters — including privacy violations, defamation, or trademark disputes — please contact us at legal@duskmaw.com.

2 Submitting a Takedown Notice

If you believe that material on our Service infringes your copyright, you may submit a DMCA takedown notice to our designated Copyright Agent. Upon receipt of a valid notice, we will act expeditiously to remove or disable access to the allegedly infringing content.

To be effective, the notice must be a written communication that includes all of the elements described in Section 3 below. Incomplete notices will not be processed.

3 Notice Requirements

A valid DMCA takedown notice must include all of the following information:

  1. Identification of the copyrighted work — A description of the copyrighted work that you claim has been infringed. If multiple works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material — A description of the material that you claim is infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., a URL).
  3. Your contact information — Your address, telephone number, and email address.
  4. Good faith statement — A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement — A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
  6. Signature — A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.
Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees incurred by the alleged infringer.

4 Counter-Notice Procedure

If you believe your content was removed or disabled as a result of mistake or misidentification, you may submit a counter-notice to our Copyright Agent. A valid counter-notice must include:

  1. Identification of removed material — A description of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed (e.g., URL).
  2. Good faith statement — A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Consent to jurisdiction — A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who provided the original DMCA notification.
  4. Your contact information — Your name, address, telephone number, and email address.
  5. Signature — Your physical or electronic signature.

Upon receipt of a valid counter-notice, we will transmit it to the original complainant and inform them that we will restore the removed content within 10 to 14 business days unless the complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

5 Repeat Infringers

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers. We reserve the right to terminate any user's account upon receipt of a single notification of infringement if we determine, in our sole discretion, that the user has engaged in repeated infringement of copyrights or other intellectual property rights.

6 Misuse of DMCA

We take the DMCA process seriously. Submitting false or misleading DMCA notices or counter-notices is illegal and may result in civil or criminal liability. We reserve the right to seek damages from parties who abuse the DMCA process, including attorneys' fees.

We may, at our discretion, forward notices and counter-notices to the opposing parties and/or third parties, and publish them as part of our transparency efforts.
